Sports, Outdoor & Equipment Risk Terms

These Sports, Outdoor & Equipment Risk Terms are an agreement between you and Sara Nelson, a California sole proprietor doing business as Cache Kits (“Cache Kits,” “we,” “us,” or “our”). They supplement the other terms that apply to your use of Cache Kits.

Danger — carbon monoxide can kill you in minutes

Generators, pressure washers, and other engine-driven or fuel-burning equipment produce carbon monoxide. This is a poison you cannot see or smell.

  • Use this equipment ONLY outside, far away from windows, doors, and vents.
  • NEVER use it inside a home, basement, crawlspace, garage, shed, tent, or other enclosed or partly enclosed space — EVEN IF doors and windows are open.
  • Use a battery-operated carbon monoxide alarm wherever fuel-burning equipment is running nearby.
  • If you feel dizzy, weak, or nauseated, get to fresh air immediately and call 911.

1. When these terms apply

These terms apply when a listing or checkout on Cache Kits identifies an item or kit as equipment requiring your acceptance. This may include:

(a) Sports and outdoor equipment — camping, climbing, hiking, water-sports, surf, paddle, snow-sports, ski, snowboard, cycling, fitness, protective, and similar recreational equipment; and

(b) Tools and appliances — powered and manual hand tools, drills, saws, tile and masonry saws, ladders and other elevated-access equipment, generators and other fuel-burning equipment, pressure washers, air conditioners and other heating, cooling, or refrigeration appliances, yard and garden equipment, and similar tools, machinery, and household appliances.

These are referred to collectively as “Covered Equipment.” A kit is Covered Equipment if any included item is identified this way.

Covered Equipment does not include equipment prohibited under the Cache Kits Terms of Service. Prohibited equipment may not be listed or rented through Cache Kits, regardless of whether a user accepts these Risk Terms.

2. Marketplace role

Cache Kits provides a marketplace that helps independent owners and renters find one another, communicate, and arrange rentals. Unless a listing expressly says otherwise, Cache Kits does not own, manufacture, inspect, test, service, maintain, select, fit, install, deliver, or supervise the use of Covered Equipment. The item owner, not Cache Kits, is the lessor of the equipment.

3. Assumption of risk

You understand that sports, outdoor activities, travel, changing weather and terrain, repair and construction work, and the use of Covered Equipment involve inherent and other risks. These may include falls, collisions, drowning, and exposure; cuts, lacerations, crushing, and amputation; eye, hearing, and respiratory injury, including from dust, debris, or fumes; electric shock and electrocution; burns, fire, and explosion; carbon monoxide poisoning and other harm from fuel-burning or unventilated equipment; high-pressure injection and impact injury; contact with refrigerants, fuels, or other hazardous substances; equipment failure or misuse; property damage; serious injury, disability, and death.

You knowingly and voluntarily assume the risks of selecting, possessing, transporting, fitting, inspecting, setting up, operating, maintaining during the rental, and using Covered Equipment, whether known or unknown, except to the extent a risk cannot legally be assumed or waived.

4. Your responsibilities

Before use, you agree to inspect the equipment and stop using it if it appears damaged, incomplete, improperly fitted, recalled, or unsafe. You are responsible for choosing equipment, activities, and work appropriate for your experience, skill, physical condition, location, and conditions; following manufacturer instructions and applicable laws, codes, and permit requirements; using suitable safety and protective equipment; obtaining instruction or professional guidance when appropriate; and preventing use by anyone not authorized under the booking.

For tools and appliances, you are also responsible for confirming that guards, shields, cords, hoses, blades, and safety devices are present and functioning, and for not removing, bypassing, or modifying them; observing load, weight, height, voltage, pressure, and duty-cycle ratings; using fuel-burning equipment such as generators only outdoors and away from occupied or enclosed spaces; verifying that electrical supply, grounding, ventilation, drainage, and mounting at your location are adequate and safe; and using a qualified, licensed professional for any installation, electrical, gas, plumbing, or structural work that calls for one.

5. Owner information is not professional advice

Listing descriptions, messages, sizing comments, setup or operating tips, recommendations, and demonstrations from an owner or another user are provided by that user. They are not a substitute for professional instruction, inspection, fitting, installation, medical advice, or your own judgment.

6. Release of ordinary-negligence claims

Read this section carefully. By accepting these terms, you give up your right to sue Cache Kits for injuries, losses, or damage caused by Cache Kits’ own ordinary negligence. Section 7 lists the claims you keep.

To the fullest extent permitted by California law, you release and agree not to hold liable Sara Nelson, doing business as Cache Kits, and Cache Kits’ service providers, contractors, and representatives for claims arising from your selection, possession, transportation, setup, operation, or use of Covered Equipment that result from their ordinary negligence. This release is intended to be clear and applies only to the fullest extent allowed by law.

7. Claims that are not released

Nothing in these terms releases or limits liability for gross negligence, reckless or willful misconduct, fraud, an unlawful act, or any right or liability that cannot legally be waived. These terms also do not eliminate any nonwaivable rights you may have under consumer-protection or product-liability law.

8. Emergency and medical responsibility

You are responsible for evaluating whether you are medically and physically able to participate in the activity or to operate the equipment safely. You authorize reasonable emergency assistance when you cannot consent, but remain responsible for resulting medical or rescue costs to the extent permitted by law. Cache Kits does not provide emergency monitoring or rescue services.

9. Electronic acceptance

By checking the acceptance box and sending a request, you confirm that you had an opportunity to read these terms, understand them, are at least 18 years old and legally able to agree, and consent to using an electronic record of your acceptance.
