Terms of Service

These Terms are an agreement between you and Sara Nelson, a California sole proprietor doing business as Cache Kits (“Cache Kits,” “we,” “us,” or “our”). They govern your use of cachekits.com, app.cachekits.com, and the Cache Kits marketplace. By using Cache Kits, you agree to these Terms and the Privacy Policy.

1. What Cache provides

Cache provides a platform that helps people discover, list, request, and coordinate local rentals of individual items and complete kits or setups. Cache is not the owner of user-listed items and is not a party to the agreement between a borrower and an owner except where expressly stated.

2. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract to use marketplace features. You agree to provide accurate information, keep your account secure, and promptly update information that changes. You are responsible for activity conducted through your account.

3. Listings and owner responsibilities

Owners must have the right to offer listed items and must describe them accurately, including condition, availability, price, included components, restrictions, and known safety issues. Owners are responsible for keeping listings and calendars current, responding to requests, preparing items for pickup, and honoring accepted rentals.

Cache may remove or restrict listings that are unsafe, unlawful, misleading, prohibited, or inconsistent with marketplace policies.

4. Requests and borrower responsibilities

A request is not confirmed until the owner accepts it and any required payment authorization or other checkout step is completed. Borrowers must use items lawfully, carefully, and only as intended; follow owner instructions and manufacturer safety guidance; avoid unauthorized transfers; and return all items on time in the condition received, ordinary wear excepted.

You are responsible for deciding whether an item or activity is appropriate for your experience, environment, and intended use. Cache does not provide professional, safety, medical, or technical advice.

5. Pickup, return, and documentation

Borrowers and owners are responsible for coordinating a lawful and reasonably safe pickup and return. Both parties should inspect items and use the available condition-documentation process at pickup and return. You agree not to falsify records or interfere with documentation.

6. Prices, payments, fees, and payouts

Prices, deposits, fees, taxes, authorizations, cancellation terms, and payout timing shown during a transaction form part of that transaction. Cache and its payment providers may authorize or charge a payment method, issue refunds, collect amounts owed, and delay or withhold payouts where reasonably necessary to handle disputes, risk, fraud, legal obligations, or policy violations.

Third-party payment providers may impose additional terms. Owners are responsible for taxes associated with their earnings unless applicable law requires otherwise.

7. Cancellations, damage, loss, and claims

Cancellation, refund, protection, damage, loss, late-return, and claims rules presented in the marketplace or during checkout apply to each transaction. Users must submit truthful information and requested documentation within the stated timeframes. Protection programs may contain exclusions, limits, deductibles, eligibility requirements, and documentation requirements and are not insurance unless expressly described as such.

8. User content and communications

You retain ownership of content you submit. You grant Cache a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, and distribute that content as reasonably needed to operate, secure, promote, and improve Cache. You represent that you have the rights needed to provide the content.

Do not submit unlawful, deceptive, infringing, abusive, discriminatory, or privacy-invasive content. Marketplace communications may be monitored or reviewed where permitted to prevent fraud, support users, enforce these Terms, or comply with law.

9. Prohibited conduct

10. Prohibited equipment

Users may not list, offer, request, rent, lend, transfer, or otherwise make available through Cache Kits any of the following:

  1. Motor vehicles required to be titled, licensed, or registered; motorcycles; all-terrain vehicles; powered recreational vehicles; or similar motorized transportation equipment.
  2. Firearms, ammunition, explosives, destructive devices, firearm components, or other weapons.
  3. Child car seats, booster seats, infant restraints, cribs, or other safety-critical equipment designed to protect an infant or child from injury.
  4. Prescription, implantable, diagnostic, therapeutic, life-support, or other regulated medical devices. Ordinary consumer fitness and wellness equipment may be permitted at Cache Kits’ discretion.
  5. Parachutes, paragliders, hang gliders, aviation equipment, aircraft components, or equipment intended to support or protect a person during aviation or airborne activities.
  6. Technical climbing or mountaineering life-safety equipment, including ropes, harnesses, belay devices, load-bearing carabiners, climbing protection, anchors, and similar fall-arrest or fall-protection equipment.
  7. Avalanche rescue or survival equipment, including avalanche transceivers, avalanche airbags, rescue beacons, probes, and other equipment whose failure could materially impair an emergency rescue.
  8. Diving life-support equipment, including scuba regulators, buoyancy-control devices, compressed-gas cylinders, rebreathers, and similar underwater breathing or life-support systems. This restriction does not necessarily apply to ordinary masks, snorkels, fins, wetsuits, or other non-life-support accessories.
  9. Any item that is subject to an active safety recall, stop-use notice, government prohibition, or unremedied manufacturer safety warning; is expired, counterfeit, illegally obtained, missing required safety labels or serial information, or prohibited by law; has been materially modified, repaired, or altered in a manner that may affect its structural integrity, safety certification, intended operation, or manufacturer warranty; or is damaged, incomplete, unsanitary, improperly maintained, or otherwise unsafe for its intended use.

Cache Kits may reject or remove a listing, cancel a transaction, restrict an account, request supporting safety or ownership documentation, or report an item to an appropriate authority when Cache Kits reasonably believes the item violates this section or creates an unacceptable safety, legal, or insurance risk. Acceptance of a risk acknowledgement or waiver does not authorize Prohibited Equipment or prevent Cache Kits from removing it.

11. Account restrictions and termination

We may investigate activity and suspend, restrict, or terminate access when reasonably necessary to protect users, prevent fraud or harm, comply with law, or enforce these Terms. You may stop using Cache at any time. Provisions that by their nature should survive termination will continue to apply.

12. Third-party services

Cache may rely on or link to third-party services, including authentication, hosting, mapping, analytics, communications, identity, payment, and support providers. Their services may be governed by separate terms and policies.

13. Disclaimers

To the fullest extent permitted by law, Cache is provided “as is” and “as available.” We do not guarantee that every user, listing, item, kit, description, review, transaction, or activity is accurate, safe, suitable, available, uninterrupted, or free from loss. You assume the risks inherent in dealing with other users and borrowing or providing physical items.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Cache and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from your use of Cache. Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Cache harmless from claims, losses, liabilities, damages, and expenses arising from your listings, rentals, content, conduct, violation of these Terms, or infringement of another person’s rights.

16. Resolving concerns

Please contact us first so we can try to resolve a concern informally. These Terms are governed by applicable law, without limiting consumer protections that apply where you live. Any dispute must be brought in a court with lawful jurisdiction unless the parties agree to another process.

17. Changes to Cache or these Terms

We may update Cache and these Terms as the marketplace evolves. We will post revised Terms and update the effective date. If a change is material, we may provide additional notice. Continued use after the revised Terms become effective means you accept them.
